The rules that govern your access to and use of RoomYaar, your listings and messages, and your responsibilities as a member.

These Terms of Service (Terms) are a binding agreement between you and RoomYaar (RoomYaar, we, us, or our) governing your access to and use of the RoomYaar website and services (the Service). By creating an account, posting a listing, messaging another user, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, Fair Housing policy, and Safety guidelines, each incorporated by reference. If you do not agree, do not use the Service.
RoomYaar is an online platform that helps people in the United States find rooms, roommates, and shared-living arrangements. RoomYaar is a neutral venue only. We are not a landlord, tenant, broker, real estate agent, property manager, or a party to any lease, rental, or roommate agreement between users. We do not own, manage, inspect, endorse, or guarantee any listing, room, or user, and we do not offer any housing ourselves. Listings, profiles, and messages are provided by users, not by RoomYaar; we do not create, verify, endorse, or take responsibility for user content or user conduct, and we take no part in any dealing between users. Any agreement you reach with another user is solely between you and that user, and you find and contact others at your own discretion and risk.
You must be at least 18 years old and able to form a legally binding contract to use the Service. By using RoomYaar you represent that you meet these requirements, are not barred from using the Service under applicable law, and will comply with these Terms and all applicable federal, state, and local laws.
You agree to provide accurate, current information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account, and you agree to notify us promptly of any unauthorized use. Do not create more than one account, share your account, or use another person's account without permission.
You retain ownership of the listings, photos, messages, and other content you submit (User Content). You are solely responsible for your User Content and represent that you have the rights to post it and that it is accurate and lawful. You grant RoomYaar a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute your User Content to operate, promote, and improve the Service. This license ends when you delete the content or your account, except for content already shared with others or retained as required by law or for legitimate business or safety purposes.
You agree not to post or do anything false, misleading, unlawful, fraudulent, defamatory, harassing, threatening, hateful, obscene, or infringing; not to spam, scrape, reverse engineer, or interfere with the Service or its security; not to impersonate others or misrepresent your affiliation; not to collect users' information for unsolicited contact; not to post listings you have no legitimate connection to; and not to move payments off-platform to evade safety measures or to defraud anyone. We may remove content and suspend accounts that violate these rules.
RoomYaar supports fair housing. You are responsible for complying with the federal Fair Housing Act and all applicable state and local fair housing laws. Do not post content that states or implies a preference, limitation, or discrimination based on race, color, religion, national origin, sex, familial status, disability, or any other characteristic protected by applicable law. Some preferences may be permitted for shared living spaces in limited circumstances, but you are responsible for ensuring your listings and communications are lawful. RoomYaar does not conduct background checks and does not verify the identity, statements, listings, or conduct of any user unless we expressly state otherwise. Any labels, badges, or verified-feeling language do not constitute verification. You are solely responsible for evaluating, and you assume all risks associated with, any user, listing, communication, meeting, tour, payment, or living arrangement. Meet in public or over video first, never wire deposits or send money before verifying the person and the property, and follow our Safety guidance.
Posting is free during launch. We may introduce fees for certain features in the future and will disclose any fees before you incur them. If and when paid features are enabled, payments are handled by a third-party payment processor (such as Stripe) subject to its terms, and you are responsible for any applicable taxes. Fees are non-refundable except as required by law or as we expressly state.
The Service, including its software, design, text, graphics, and the RoomYaar name and logo, is owned by RoomYaar or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended personal, non-commercial purpose. You may not copy, modify, distribute, or create derivative works from the Service except as these Terms permit.
If you believe content on RoomYaar infringes your copyright, email hello@roomyaar.com with the information required by the Digital Millennium Copyright Act: identification of the work and the allegedly infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. We respond to valid notices and terminate repeat infringers where appropriate.
The Service relies on and may link to third-party services (for example, sign-in, maps, image hosting, email, and payment providers). We are not responsible for third-party services or content, and your use of them may be subject to their own terms and privacy policies.
THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RoomYaar does not warrant listing accuracy, roommate compatibility, availability, security, or any housing outcome, and does not warrant that the Service will be uninterrupted or error-free.
TO THE FULLEST EXTENT PERMITTED BY LAW, RoomYaar AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, OR FOR ANY DISPUTE OR INTERACTION BETWEEN USERS. RoomYaar's TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID RoomYaar IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless RoomYaar and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, your interactions or agreements with other users, or your violation of these Terms, any law, or the rights of a third party.
You are solely responsible for your interactions, communications, and dealings with other users, including any tours, meetings, payments, agreements, and living arrangements. RoomYaar is not involved in and is not responsible for these interactions. To the fullest extent permitted by law, you release RoomYaar and its owners, employees, and agents from any and all claims, demands, damages, and losses of every kind arising out of or connected with any dispute or interaction with another user or a listing. If you are a California resident, you waive California Civil Code Section 1542, which provides that a general release does not extend to claims that the releasing party does not know or suspect to exist in their favor at the time of the release and that, if known, would have materially affected the settlement. You waive similar protections under the laws of other states.
You may stop using the Service and delete your account at any time. We may suspend, restrict, or terminate your access, and remove content, at our discretion, including if we believe you have violated these Terms, applicable law, or community safety, or to protect users or the Service. Sections that by their nature should survive termination (including any content license for shared content, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
If you have a dispute with RoomYaar, please first contact hello@roomyaar.com so we can try to resolve it informally; most concerns can be handled that way. If a dispute cannot be resolved informally, it will be handled in the state or federal courts located in the state where RoomYaar's operator is located, and you and RoomYaar consent to the personal jurisdiction of those courts. Each party waives any right to a jury trial to the extent permitted by law.
These Terms are governed by the laws of the United States and the state in which RoomYaar's operator is located, without regard to conflict-of-laws rules.
We may update these Terms from time to time. If we make material changes, we will update the Last updated date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
These Terms, together with the policies referenced here, are the entire agreement between you and RoomYaar regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
